Privacy Policy

This Privacy Policy (hereinafter referred to as Privacy Policy) describes the data handling policy of PPT Group Limited Liability Company, the operator of the nyooy community builder website located at nyooy.com (hereinafter referred as to the nyooy website), in line with the provisions of Act LXIII of 1992 on the Protection of Personal Data and the Disclosure of Information of Public Interest (hereinafter referred to as Data Protection Act).

4. Purpose of Data Processing

Data Processing of the Service Provider is conducted in order to identify the Users and to enable the use of the community platform, available at nyooy website, including all of its services and functions (hereinafter referred to as nyooy services). For the purposes of this Privacy Policy users shall mean the registered users at nyooy website/the costumers of Genie Platform Services (hereinafter referred to as User).

This Privacy Policy covers any operation or set of operations which is performed upon data, irrespective of the applied procedure, such as collection, obtaining, recording, organisation, storage, alteration, use, transfer, making public, alignment or combination, blocking, deletion or destruction, as well as the barring of their further use. Photographing, sound or image recording, as well as the recording of physical characteristics suitable for personal identification (such as fingerprints, and palm prints, DNA samples and iris images) shall also be considered as data processing (hereinafter referred to as Data Processing)

According to Section 5 of the Data Protection Act, the Service Provider shall process the collected personal data solely for the specified purpose as set out in this Section of the Privacy Policy and also ensures that the data processing is in compliance with the specified purposes in all phases of the data processing.

The Service Provider shall only process personal data if it is indispensable and suitable for the achievement of the purpose of data processing, and only to the extent and for the duration necessary to achieve that purpose. The Service Provider shall not use or process personal data for other purposes as specified in the Privacy Policy.

The purpose of processing compulsory personal data submitted by Users is to identify the User's entitlements. Such User personal data may be used for statistical purposes, and for displaying personalized advertisements on downloaded sites during the User's visit at the nyooy website. Users may control and prohibit the use of their data for such purposes.

The User information recorded in log files during the use of the nyooy services shall only be used for statistical purposes. By accepting this Privacy Policy the User agrees that the Service Provider may collect anonymous statistical User information for the operation of the nyooy services.

5. Legal Basis of Data Processing

According to Section 3, Subsection (1) of the Data Protection Act personal data shall not be processed only if the data subject has given his or her voluntary, informed, unambiguous consent.

6. Scope of Data Processing

The scope of data processing covers the compulsory personal data submitted by the Users during the registration process, such as User name, email address, password. On the basis of the User's decision, User may customize his or her User profile (hereinafter referred to as Profile) with further information, including other user names and passwords, that are submitted while the User login at nyooy services by using other applications (e.g. Twitter, Facebook) (hereinafter referred to as Other Applications).

Upon the User may login at nyooy services by using Other Applications, the Service Provider shall handle personal data that are available according to the terms of use and Privacy Policy of the other applications.

The User shall control how to share the aforementioned personal data with other Users through the „Application Settings” of the User's Profile.

When using the nyooy services the following information shall be collected from the User's device: (1) location and (2) Internet protocol (IP) address of the User's computer, (3) the date and time of the visit, and in certain cases – depending on the settings of the User's computer – the (4) computer operating system and (5) type of web browser. The system shall gather the aforementioned data automatically and store it in log files. The Service Provider does not link this automatically-collected data to personally identifiable information.

7. Data Transmission

According to Section 8, Subsection (1) of the Personal Data Act, the Service Provider shall solely transfer personal data to third parties upon the prior and informed consent of the User or if such data transmission is provided for by an Act, and on the basis of the relevant authorities' request. The Service Provider shall examine the compliance with the legal basis and obligation of data processing before every request from authorities with regard to every personal datum.

8. Time of Data Processing

The period of time for handling the compulsory data is the effective period of this Privacy Policy. The period of time for handling further personal data submitted voluntarily by the Users is the period until the User shall not delete such data from his or her Profile or, if it is longer, the effective period of this Privacy Policy.

If the User unlawfully, misleadingly uses personal data or violates the provisions of the Terms of Use (hereinafter referred to as Agreement) and thus the Service Provider terminate the Agreement, the Service Provider is entitled to delete immediately all personal information of the User when the registration is deleted.

The period of time for handling data recorded in the log-files during the use of nyooy services, is six (6) days from the day of visiting.

9. Deletion of Personal Data

The User's deletion request for deleting his or her personal data shall be send at nyooy@nyooy.com. Upon the voluntary decision of the User, the Service Provider shall delete the User's personal data accordingly to Section 10 of this Privacy Policy, within five (5) working days from the receipt of the deletion request of the User.

10. Personalized advertisement and contents

The Service Provider is entitled to display personalized advertisements on downloaded sites during the User's visit at the nyooy website. The Service Provider shall use personal data as set out in Section 7 (Purpose of Data Processing) of this Privacy Policy in order to display personalized advertisements and contents on downloaded sites and advertisement surfaces (banner). The assignment of advertisement surfaces and personalized contents are conducted by computer programmes, personally identifiable information shall not be processing during the assignment. Users may control and prohibit the use of their data for such purposes.

11. Security

The Service Provider reserves the right to modify this Privacy Policy or any part thereof at any time with the prior notice of the Users. After the entry into force of the amendments, the continued use of the Services shall be deemed to attest to the User's consent to any amendments to the Agreement.

Users are entitled to request information regarding the processing of their personal data in line with Section 10 of the Data Protection Act. The Service Provider shall inform the User, upon his or her request, on the data processed by the Service Provider, on the purpose of data processing, on the legal basis and duration of the data processing, of the name, address (seat) and activity of the technical data processor in connection with the data processing, as well as of those who received or will receive data and for what purpose. The request shall be send at nyooy@nyooy.com and the Service Provider is obliged to answer within ten (10) working day from the receipt of the request. The Users are also entitled to request the deletion of their personal data accordingly to Section 10 (Deletion of Personal Data) of this Privacy Policy.

14. Enforcement

The enforcement of User's rights is based on the Data Protection Act and on Act IV of 1959 on the Civil Code. The User may also submit his or her request to the Parliamentary Commissioner of Data Protection (The Office of the Data Protection Commissioner, 1051 Budapest, Seat: Nádor u. 22. Postal Address: 1387 Budapest Pf. 40.). The method of enforcement and the detailed obligations of the data controller are set out in the Data Protection Act and the Civil Code.
