Terms of Use

(hereinafter referred to as Agreement)

This website is owned by PPT Group Limited Liability Company, a company incorporated under the laws of Hungary, having its registered seat at 1061 Budapest, Király utca 16. II. em. 239., Tax No. 13306265-2-42; Name of the Bank: CIB Bank Zrt., Bank Account No.: 10702198-48992509-51100005; Court of registration: Municipal Court of Budapest, acting as Court of Registration; Registration No.:01-09-728504; duly represented by: Bődi Gábor managing director. Contact info: nyooy@nyooy.com; hereinafter referred to as nyooy or Service Provider.

This Agreement governs the general terms of use of the community builder website located at nyooy.com (hereinafter referred to as nyooy services or Services); the Agreement also describes the terms of ethical use and constitutes the unacceptable uses of nyooy services.

1. Services

The nyooy services shall mean the social networking platform available at www.nyooy.com including all of its services and functionalities. For the purposes of this Agreement users shall mean the registered users at nyooy.com (hereinafter referred to as User).

By visiting or using the nyooy services the User accepts and agrees to be bound by this Agreement. The nyooy services are provided by the Service Provider, and to use this Services the User understands and agrees to the following:

(a) or the use of nyooy services User shall submit valid e-mail address and as part of the registration process shall select a password (e-mail address and password hereinafter referred to as Identifiers);/p>

(b) the User is responsible for maintaining the confidentiality of the password, and the Service Provider shall not be responsible or liable for any damage or loss incurred as a result of the loss of the password;/p>

(c) the User shall notify the Service Provider of any unauthorized use of the Identifiers;

(d) the User hereby acknowledges that (s)he has full legal capacity to enter into this Agreement;

(e) the User hereby agrees and accepts to be bound by all and any terms and conditions in connection with the use of nyooy services;

(f) the User further acknowledges that all data in relation to the use of nyooy services, including personal data, information and Contents published by the User are processed and stored within the territory of Hungary or the European Union.

By accepting this Agreement, User agrees and declares to refrain from any unacceptable uses as determined by the Service Provider.

2. Registration process and User data

For the use of nyooy services, as part of the registration process, the User shall not submit false or misleading information to nyooy, including but not limited to the User's personal name or his or her other personally identifying information. The Service Provider reserves the right, in order to avoid the use of false or misleading personal identifiers, to verify the User's identity.

The User shall take all necessary steps to ensure that his or her personal information, including but not limited to the password used to login at nyooy services, are kept confidential and secure. The User shall inform the Service Provider immediately at nyooy@ppt.eu in case of the loss of his or her Identifiers or if the Identifiers are, or are likely to be, used without authorisation. The User shall be responsible for any and all events and acts resulted from the use of his or her Identifiers. Until the User notified the loss or unauthorized use of the Identifiers, all acts by any third parties shall be regarded as an act by the User, and any consequences resulting from this, will be the User's responsibility.

The User shall solely assign his or her User profile to third parties upon the prior written consent of the Service Provider.

By accepting this Agreement, the User acknowledges and agree that the Service Provider may collect and aggregate anonymous User information and integrate such information anonymously into the system of nyooy services; such User information may be be aggregated for the purpose of building anonymous statistical and analytical reports.

Use of the nyooy services is also governed by the Privacy Policy (hereinafter referred to as Privacy Policy). By using the nyooy services the User also agrees to the terms of the Privacy Policy.

3. Content

User shall be solely responsible for the Content that (s)he may post, upload or display on, through or in connection with any of the nyooy services, including but not limited to photos, personal information, chats, lists, labelling, personal messages or any other materials posted through the nyooy services, including the results thereof (hereinafter referred to as Content).

The Service Provider shall not monitor actively the Contents, posted, displayed or otherwise provided by the Users. The Service Provider as an intermediary service provider shall not be liable for the information transmitted.

3.1

By accepting this Agreement the User shall agree that the Service Provider may remove, without prior notice, any Content or link to such Contents from the nyooy services, if the Service Provider, in its sole discretion, determines the Contents to be unlawful, violating third parties personal rights, fraudulent, offensive, defamatory, slanderous, obscene or otherwise objectionable.

The Service Provider's right to remove User's Contents from the nyooy services covers Contents or links to such Contents that infringes or violates the intellectual property rights, copyrights and other copyright-related rights or other proprietary rights of any person or such Contents violates the provisions of this Agreement.

3.2

According to this Agreement the following User conducts shall be unacceptable:

Modification, adaptation or reverse engineering of the nyooy services and its related programmes or any portion thereof, or attempting such modification, adoption or reverse engineering or any other activities;

Re-formatting or re-editing of the websites of nyooy services;

Unlawful use of nyooy texts, graphics, logos and design.

Damaging the name and reputation of the Service Provider and the nyooy services.

4. Security

4.1

By accepting this Agreement the User shall agree not to use the nyooy services for harassing, defaming, slandering other Users or violating other Users' human dignity or violating the constitutional equality principle or otherwise violating the personal or other rights of other Users.

4.2

The User further agrees not to use the nyooy services for the establishment of unsolicited communications or transmission of unsolicited mass mailing, including but not limited to „spamming” or intentional distribution of hoaxes.

4.3

By accepting this Agreement the User agrees not to use the nyooy services in any way that is unlawful or unauthorized.

According to this Agreement, additionally to the aforementioned general prohibition, the following activities are strictly prohibited in conjunction with the use of nyooy services. Unaccepted Users' activity include, but is not limited to:

Any attempt to interfere or interfere with the proper operation of nyooy services;

Use of any automatic device, search engine robot, site search or retrieval application or any other manual or automatic device or process to retrieve or index any portion of the nyooy services;

Any unauthorized access or any attempt to access to nyooy computer system (hacking);

Any unauthorized collection of information about other Users (including User accounts and email addresses);

Creation of User accounts by automated means or under false or fraudulent pretences;

Use of nyooy services for any other illegal activities.

5. Amendment

The Service Provider reserves the right to modify the Agreement or any part thereof at any time with the prior notice of the Users. After the entry into force of the amendments, the continued use of the Services – such as to login at nyooy services - shall be deemed to attest to the User's consent to any amendments to the Agreement.

6. Breach of Contract

The Service Provider reserves the right to delete User profiles or restrain User's right, upon determining, in its sole discretion, that the User committed a serious violation of this Agreement or of the Privacy Policy.

According to Section 2 of this Agreement, the Service Provider reserves the right, in order to avoid the use of false or misleading personal identifiers, to verify the User's identity. In line with the aforementioned right, the Service Provider is entitled to send a test email to the User, who is obliged to reply to this email within 24 hours; if the User fails to reply on time, his or her User account shall be deleted.
